Important — what Boris is, and what Boris is not

Boris is an advice service. It bundles and learns from best-known practices and shares feedback on the cases you present to it. At no single moment is Boris's verdict final or decisive. Boris offers a suggestion, learnings and its best current understanding — it cannot be held accountable for what you do with that information. Boris is not without flaw: it is smart and learning, but it can make mistakes. It is up to you to judge and act accordingly.

1. Who you are contracting with

Boris (the "Service") is operated by underdogdesign ("we", "us"). By using the Service you are entering into an agreement with underdogdesign.

2. Acceptance

By accessing or continuing to use Boris, you agree to these Terms. If you do not agree, do not use the Service. You confirm you have the authority to enter into these Terms and are of legal age in your jurisdiction.

3. Nature of the Service — advice only, no reliance

Boris helps you assess whether links, messages, images, audio or files look like scams or phishing. Boris is an advisory tool: it bundles and continuously learns from best-known practices and surfaces a suggestion, signals and its best current understanding for each case you submit.

Boris's verdict is never final or decisive. Verdicts, scores, confidence levels, explanations and recommended actions are informational only, may be incomplete, outdated or wrong, and must not be relied on as the sole basis for any decision. Boris can and will make mistakes. You remain solely responsible for verifying important matters independently and for whatever action you take (or do not take) on the basis of Boris's output. Boris is not legal, financial, security, compliance or other professional advice.

4. Acceptable use

You agree not to misuse the Service. In particular you must not:
  • use the Service unlawfully, fraudulently, or to send spam;
  • infringe intellectual property or privacy rights of others;
  • upload malware or attempt to probe, scan, or interfere with the Service's security;
  • scrape, reverse engineer, resell or redistribute the Service;
  • circumvent technical limits, plan quotas, or access controls.

5. Accounts

You must provide accurate information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account.

6. Intellectual property

We retain all rights, title and interest in the Service, including software, models, branding and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of content you submit and grant us a limited licence to host and process it solely to operate and improve the Service.

7. Payments, subscriptions, taxes and refunds

Our order process is conducted by our payment provider Stripe. Stripe processes payments, handles tax calculation and collection, and supports refunds and disputes for eligible transactions.

Payment, billing, taxes, currency, renewals, cancellations and refunds are governed by Stripe's terms at stripe.com/legal. Subscriptions renew automatically until cancelled.

8. Service availability

We do not guarantee that the Service will be uninterrupted, error-free, or always available. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, consequential, special or incidental damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify us against claims arising from content you submit, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction where underdogdesign is established, without regard to conflict-of-laws principles. Courts of that jurisdiction have exclusive jurisdiction over disputes, subject to any mandatory consumer protections in your country of residence.

14. Automated processing and AI limitations

Boris uses automated rules and large language models. Output is generated statistically and may contain errors, omissions or "hallucinations". Boris does not verify the real-world identity, legitimacy or solvency of any person, company, bank, domain or payment detail, and a "safe" signal is never a certification, guarantee or endorsement. No automated decision producing legal effects is taken about you by the Service.

15. No duty to detect; third-party content and links

We have no obligation to detect, block, report or warn about any specific scam, fraud, malware or unlawful content, and no monitoring duty. Boris may reference third-party sources, databases, websites or links; those are provided for convenience only, we do not control them and accept no responsibility for their content, accuracy or availability. Any dealings you have with a third party are solely between you and that third party.

16. Not an emergency, reporting or professional service

Boris is not an emergency service and is not a channel for reporting crime, fraud or abuse to any authority. If you believe you are a victim of fraud, contact your bank, the police or the competent authority in your country directly. Boris does not act as your adviser, agent, fiduciary, insurer or security provider, and using Boris creates no professional, advisory or fiduciary relationship.

17. Force majeure, severability, assignment, entire agreement

We are not liable for failure or delay caused by events beyond our reasonable control (including outages of hosting, network, AI or payment providers). If any provision is held unenforceable, the remainder stays in force and the provision is applied to the maximum extent permitted. We may assign these Terms to a successor of our business; you may not assign without our consent. These Terms and the Privacy Notice form the entire agreement between us. No waiver of a right is implied by delay in enforcing it.

18. International use, consumer rights and disputes

The Service is offered worldwide from Europe. You are responsible for compliance with the laws of your own country, and you must not use the Service where doing so would be unlawful. Nothing in these Terms removes rights you have as a consumer that cannot be waived under mandatory local law — including, where applicable, EU/EEA and UK consumer legislation, statutory guarantees under Australian Consumer Law, or comparable protections. Where required, EU consumers may also use the European Commission's online dispute resolution platform. Where permitted by law, disputes are resolved individually and you and we waive any right to bring or participate in a class, collective or representative action. Before starting proceedings, please contact us so we can try to resolve the matter informally.
